{"id":11133,"date":"2026-01-13T09:52:05","date_gmt":"2026-01-13T09:52:05","guid":{"rendered":"https:\/\/velo.riodigital.com.ar\/pensando-en-hacer-un-giveaway\/"},"modified":"2026-07-24T13:22:37","modified_gmt":"2026-07-24T13:22:37","slug":"pensando-en-hacer-un-giveaway","status":"publish","type":"post","link":"https:\/\/velo-legal.com\/en\/blog\/pensando-en-hacer-un-giveaway\/","title":{"rendered":"\u00bfPensando en hacer un giveaway?"},"content":{"rendered":"<p>\u00bfSab\u00edas que un simple giveaway con tus followers podr\u00eda ocasionarte una multa por parte del Estado?<\/p><p>La Junta de Control de Juegos del Ministerio de Econom\u00eda y Finanzas (JCJ) es la entidad encargada de supervisar los juegos de azar, conocidos usualmente como promociones comerciales, rifas, casino y apuestas en general. Uno pensar\u00eda que un <em>giveaway<\/em>, al no ser una actividad en la que el organizador recauda dinero de alguna forma o en la que los participantes adquieren boletos onerosamente, no entrar\u00eda dentro de las actividades reguladas en la Resoluci\u00f3n No. 059 de 1999, pero es todo lo contrario.<\/p><p>Los<em> influencers<\/em> o comercios organizan <em>giveaways <\/em>opromociones comerciales de manera irregular, sin tener conocimiento que estas actividades requieren permisos emitidos por la JCJ cuando se ofrezca la oportunidad de participar y ganar premios en la medida de que (i.) los seguidores sigan ciertas cuentas, comenten algo en cierto post o nombren a cierta cantidad de amigo, y (ii.) que el ganador se escoja al azar.<\/p><p>Uno se pregunta en estas situaciones si el gobierno tiene el personal adecuado para hacerle frente a la cantidad de<em> giveaways<\/em> que se realizan a diario o si estas multas son significativas. La realidad de este asunto es que<strong> <\/strong>la JCJ revisa constantemente las redes sociales, dando como resultado que varios<em> influencers<\/em> y comercios hayan reportado que han recibido advertencias y multas por parte de la JCJ, estas \u00faltimas por montos que seg\u00fan la Resoluci\u00f3n No. 059 de 1999 pueden llegar desde B\/. 1,000.00 hasta B\/. 50,000.00.<\/p><p><em>\u201cArt\u00edculo 113: Las violaciones al presente Reglamento ser\u00e1n sancionadas con multa no menor de Mil Balboas (B\/. 1,000.00) ni mayor de Cincuenta Mil Balboas (B\/. 50,000.00), sin perjuicio de la cancelaci\u00f3n de la actividad o de la prohibici\u00f3n de realizar nuevos juegos de suerte y Azar durante un periodo no mayor de un (1) a\u00f1os cuando as\u00ed se estime conveniente\u201d.<\/em>Esto no quiere decir que los comercios o<em> influencers<\/em> no puedan desarrollar <em>giveaways <\/em>de ningun tipo.
