{"id":11119,"date":"2021-08-02T00:00:00","date_gmt":"2021-08-02T00:00:00","guid":{"rendered":"https:\/\/velo.riodigital.com.ar\/nueva-ley-de-proteccion-de-datos\/"},"modified":"2026-07-23T15:15:19","modified_gmt":"2026-07-23T15:15:19","slug":"nueva-ley-de-proteccion-de-datos","status":"publish","type":"post","link":"https:\/\/velo-legal.com\/en\/blog\/nueva-ley-de-proteccion-de-datos\/","title":{"rendered":"Nueva ley de protecci\u00f3n de datos"},"content":{"rendered":"<p><strong>En vigencia a partir del 29 de marzo de 2021.<\/strong><\/p><p>La Ley 81 de 2019 sobre Protecci\u00f3n de Datos tiene como objetivo establecer los principales derechos, obligaciones y procedimientos que regulan la protecci\u00f3n de datos personales en Panam\u00e1.<\/p><p>Los aspectos mas importantes que debes tener en cuenta:<\/p><ul style=\"--framer-text-color: rgba(1, 1, 1, 0.56); --framer-font-size: 16px; --framer-text-transform: none; --framer-text-stroke-width: 0px; --framer-text-alignment: start;\"><li data-preset-tag=\"p\" style=\"--framer-font-size: 16px;\"><p>Toda persona puede efectuar el tratamiento de datos personales siempre que lo haga cumpliendo con la Ley y para los fines permitidos en la misma.<\/p><\/li><li data-preset-tag=\"p\" style=\"--framer-font-size: 16px;\"><p>La ley aplica a las bases de datos que se encuentren en el territorio de la Rep\u00fablica de Panam\u00e1, que almacenen o contengan datos personales de nacionales o extranjeros, o que el responsable del tratamiento de datos este domiciliado en Panam\u00e1.<\/p><\/li><li data-preset-tag=\"p\" style=\"--framer-font-size: 16px;\"><p>Quedan exentos de la aplicaci\u00f3n de esta ley aquellos tratamientos de datos que se encuentran regulados por leyes especiales (ej. Ley de seguros, bancaria etc.)<\/p><\/li><li data-preset-tag=\"p\" style=\"--framer-font-size: 16px;\"><p>Las personas que tengan acceso o est\u00e9n involucradas en el tratamiento de datos personales, est\u00e1n obligadas a guardar confidencialidad, obligaci\u00f3n que no cesa por haber terminado sus actividades en este \u00e1mbito.<\/p><\/li><li data-preset-tag=\"p\" style=\"--framer-font-size: 16px;\"><p>Los datos personales deben utilizarse para los fines determinados, expl\u00edcitos y l\u00edcitos para los cuales han sido autorizados al momento de su recolecci\u00f3n.<\/p><\/li><li data-preset-tag=\"p\" style=\"--framer-font-size: 16px;\"><p>Los datos sensibles no pueden ser objeto de transferencia con excepci\u00f3n de los casos puntuales establecidos en esta ley.<\/p><\/li><li data-preset-tag=\"p\" style=\"--framer-font-size: 16px;\"><p>El custodio de la base de datos regulada por la Ley de Protecci\u00f3n de Datos es responsable por aquellos da\u00f1os y perjuicios ocasionados que le sean exigibles.<\/p><\/li><li data-preset-tag=\"p\" style=\"--framer-font-size: 16px;\"><p>Las infracciones a esta Ley se califican como leves, graves o muy graves.
